How Do I Prove I Qualify for Deferred Action?

The deferred action application form and instructions on how to complete it will be available on the USCIS website August 15, 2012. With the date fast approaching, you should start thinking about the supporting evidence you can include with your application to show you qualify for deferred action.

Our office developed the following list of evidence to serve as your guide. Please note, that not all of the items on the list will be applicable to your case. However, our hope is that the list will serve as a good guide for you to come up with the documents which would be helpful in your case.

Here is the list of documents which would serve as good evidence for a deferred action application:

Showing Your Identity and Age (any of the following, even if EXPIRED):

  • Government issued ID
  • Consular issued ID
  • School ID
  • ID documents issued by the DHS
  • Birth Certificate
  • Copies of passport biographic page
  • Church records (baptismal, communion, confirmation certificates)

If you came to the U.S. lawfully, any of the following:

  • Copies of I-94, visa, border crossing card
  • Copies of applications filed with DHS
  • Any documents showing was/is in removal proceedings
  • Results of the FBI background checks showing stops at the border

Showing You Came to the U.S. Before the Age of 16 and resided in the U.S. continuously:

  • Official school transcripts
  • School diploma
  • Report cards
  • Immunization, medical records
  • Letters of recommendation from teachers
  • Sward letters
  • Sports/academic clubs records
  • Bills (utility, cable, internet, cell phone, health/life/auto/home insurance)
  • Bank statements
  • Lease agreements
  • Employment records (pay stubs, W-2s, tax returns)
  • Military records (Form DD-214)
  • Selective service registration (to obtain, go to sss.gov)
  • Census records (to obtain, go to census.gov)
  • Social security records
  • Receipts of purchase (groceries, articles of clothing, home appliances, etc.)
  • Deeds, mortgages, title documents, vehicle registration, other contracts
  • Money order receipts
  • Airfare itineraries
  • Hotel receipts
  • Notarized affidavits from persons who know applicant (family, friends, neighbors, teachers, doctors, pastors, etc., stating their name, DOB, address, circumstance of getting to know the applicant, specific instances of interaction)
  • Marriage licenses
  • Certified copies of children’s birth certificates
  • Children’s school, medical records, immunization records

Showing You Were Physically Present in the U.S. on June 15, 2012:

  • Any of the evidence from the list above, which shows a specific date

Showing Your Absence (if any) was Brief, Casual and Innocent:

  • Travel documents
  • Letter justifying and explaining absence

Showing You Are Currently in School, or Have Graduated, Obtained a GED, or You Are an Honorably Discharged Veteran of the U.S. Coast Guard or Armed Forces:

  • School diploma
  • GED certificate
  • School transcripts, report cards
  • Letters from teachers
  • Awards
  • Participation in sports/clubs
  • Form DD-214 (if a veteran)

Showing Your Charges or Convictions (if any):

  • Certified copies of dispositions from each citation, arrest, or proof no charges were filed
  • Results of the FBI background check
  • Results of the DOJ background check
